Telehealth Informed Consent

This Telehealth Informed Consent ("Consent") describes the nature of telehealth services made available through the Mevita Health platform, operated by BMRX Health LLC ("Mevita Health," "we," "our," or "us"), and the licensed healthcare providers accessible through it ("Providers"). Please read this Consent carefully. By using the Services, creating an account, or completing an intake, you acknowledge that you understand and agree to the terms below.
1. What Telehealth Is
Telehealth involves the delivery of healthcare services using electronic communications, information technology, or other means between a healthcare provider and a patient who are not in the same physical location. Telehealth may be used for diagnosis, treatment, follow-up, patient education, and prescription management, and may include: asynchronous review of your health questionnaire and medical history; secure messaging with a Provider; audio or video consultations; and transmission of your health records, images, or other data.
2. The Provider Relationship
Mevita Health is a technology platform and is not a healthcare provider. Healthcare services available through the platform are provided by independent, licensed Providers who exercise their own independent medical judgment. Completing an assessment or intake on this website does not, by itself, create a doctor-patient relationship. A doctor-patient relationship is formed only if and when a Provider reviews your information and agrees to treat you.
3. No Guarantee of Prescription or Treatment
Submitting an intake, questionnaire, or payment information does not guarantee that you will receive a prescription or treatment. All treatment decisions, including whether any medication is appropriate for you, are made solely by a licensed Provider based on your individual health information and their independent clinical judgment. Providers may decline to provide treatment where it is not clinically appropriate.
4. Expected Benefits of Telehealth
- Improved access to care, allowing you to receive an evaluation without traveling to a clinic.
- More efficient evaluation and management of your care.
- Convenient follow-up and ongoing communication with your Provider.
5. Potential Risks of Telehealth
As with any healthcare service, there are potential risks associated with telehealth, including but not limited to:
- Information transmitted may be insufficient (for example, poor image quality or incomplete medical history) to allow appropriate medical decision-making by the Provider.
- Delays in evaluation or treatment could occur due to failures of electronic equipment or connectivity.
- A lack of access to your complete medical records may result in adverse drug interactions, allergic reactions, or other errors of judgment.
- In rare instances, security protocols could fail, causing a breach of privacy of personal health information.
- Telehealth may not be as complete as an in-person visit, and your Provider may determine that you require in-person care.
6. Alternatives to Telehealth
Alternatives to telehealth services are available to you, including in-person visits with a physician or other healthcare professional of your choosing. You may withdraw from telehealth services and seek in-person care at any time.
7. Emergencies
The Services are not intended for medical emergencies. If you believe you are experiencing a medical emergency, call 9-1-1 or go to the nearest emergency room immediately. If you are experiencing a mental health crisis, you may also call or text the Suicide and Crisis Lifeline at 9-8-8.
8. Your Rights
- You have the right to withhold or withdraw your consent to telehealth services at any time without affecting your right to future care or treatment.
- You have the right to ask questions about the information in this Consent and about any procedures, treatments, or medications recommended to you. Your Provider will answer your questions.
- You have the right to request an in-person visit or a synchronous (live audio/video) consultation where required or preferred, subject to applicable state law and Provider availability.
- You have the right to access your medical information in accordance with applicable law.
9. Privacy and Security
The electronic communication systems we use incorporate reasonable administrative, technical, and physical safeguards designed to protect your health information. The laws that protect the privacy and confidentiality of medical information also apply to telehealth. Please see our Privacy Policy for details on how your information is collected, used, and shared.
10. State-Specific Requirements
Telehealth services are subject to the laws of the state in which you are located at the time of service. Some states require a synchronous (live audio or video) consultation before treatment can be provided, and the availability of specific services or medications may vary by state based on state regulations and Provider licensure. By using the Services, you confirm that the location you provide during intake is accurate.
11. Medications
If a Provider prescribes medication, it is your responsibility to take the medication as directed, review all patient information provided with the medication, and promptly report any side effects or concerns to your Provider. Certain medications available through the platform may be compounded medications. Compounded medications are prepared by licensed pharmacies but are not FDA-approved and have not been evaluated by the FDA for safety, efficacy, or quality. Your Provider will use their clinical judgment in determining whether a compounded medication is appropriate for you, and you are encouraged to discuss the risks and benefits of any medication with your Provider.
12. Acknowledgment
By using the Services, you acknowledge and agree that:
- You have read and understand the information provided in this Consent;
- You understand the potential benefits, risks, and alternatives of telehealth services;
- You understand that no prescription or treatment is guaranteed;
- You are at least 18 years of age; and
- You voluntarily consent to receive healthcare services via telehealth from Providers accessible through the Mevita Health platform.
